Protection from Third-Party Appraisal Report Users

SUGGESTION 1: It's my opinion that the best way to make sure that your clients take responsibility for the dissemination or distribution of your appraisal reports is to get them to agree to protect the reports and your firm in writing. I'm not an attorney, and I'm not saying that this blurb that follows will totally protect you, but I have used a similar provision in my engagement letters and it has already kept me out of trouble.
Appraisal Reports for Litigation 5 - At Trial

Make sure when you have a trial date, time and location that you check and double check your information. Showing up late when you have a room full of attorneys, jurors, your client and the judge kept waiting is as bad a start as you can imagine. While preparation is of utmost importance, you can't defend your appraisal if you can't remember what you wrote in it, trial situations are stressful and not what appraisers are used to. When you get the first 20 trials behind you it will get easier, but even then there are some cases in which the attorneys and judges are difficult to deal with.

Appraisers are already busy dealing with the valuation of many of the new senior care facility alternatives in the form of small group homes and unlicensed assisted living facilities. I have discussed small facilities, often just single-family homes, and how their group home use can alter their single-family residential character in another article on this site. Appraisals of this type are dangerous for appraises unless they understand that a business is being run from the building that is separate from the real estate.
Narrative Report Writing 10 - Layout Enhancements

Based on what I have seen over the last year or so the trend in report writing appears to be toward the use of more color and more graphics in appraisal reports. The plain, clean black and white reports that I have always favored are now becoming what you would expect to receive from a stock market brokers offering for an initial public offering (IPO). Apparently many appraisers have reached the point where they feel it has become generally accepted that the research and data used in a appraisal report cannot on its own differentiate its quality, now a reports have to look better than a competitors.
